I really hope you have gotten yourself a lawyer. You should have no trouble getting one on a contingent fee for this type of suit if money is a concern. You need to have those witnesses deposed. I promise the city is in no rush to help you in your suit against... the city - hopefully you realize this? I just took the bar last week - i might be a lawyer (won't know till June).

Yeah, I am fortunate to have one of the best lawyers in Houston. He represented my brother a few years ago when he was in a motorcycle accident. He's also helping now bc my car is sitting in the shop, no one can fix it, it's got 20k in it, and Liberty Mutual has to make a decision.. And ultimately that decision is going to cost them.

The original adjuster and shop are going to go down for this one ultimately. Liberty Mutual will get all their money back and then some when it's all over and done with. Make sure you get your cut.

Insurance was still trying to fix it last week. I finally spoke with someone that could DO something! I asked him a few questions he couldn't answer.. "If your daughter and grandchild were to drive away in that car, how safe would you feel? IF by some fluke y'all find the actual problem, are you willing to guarantee that those airbags won't deploy when I'm driving down the road? Or that they will deploy when I need them to? I understand that y'all will lose money if you have to write this off, but at what point do you consider your customer's best interest?"

They've re-wired and replaced the same things several times. They've failed to look at the bigger picture and realize this is more likely a computer problem, not a problem with wires ::)

Also just found out that they have finally filed a claim against the city. Which opens up the opportunity to sue them. Waiting on my lawyer to get out of court today ;)
 
Good for you. Stick it to them and stand your ground, this really sucks for you to have to go through but sounds like you are almost out of it.
 
Would love to see the dash cam of the accident. But either way he is an officer and he ran a red with no lights and siren at speed instead of a California stop like every cop I've ever seen go through a traffic light. Being as it was a school cop that would mean he was probably more than likely in a school zone which makes him liable on sooooooo many levels. Since you have lawyered up I would shove this down his,the city's,the shop and your insurance co's throats and get what you deserve and then some. That waiting period on investigating accidents just gives that person to put other peoples lives in danger for a lot longer and is exuberantly negligent on the city's part. I'd go to city council and have that by law changed as soon as your done with all of this shinnanigins. Good luck
 
At the accident, dude says he had no dash cam. Trying to find out the laws on this; I know that regular cops are required to have it on at all times, and fault would automatically be his if it wasn't.. Not sure about the school cops though

This had been dormant for a bit and I'm just wondering how it's working out. It it's still going on, I would start being the controller of the situation. Start by telling the shop to stop working on it. Then call LM and tell them you ordered the shop to stop working on it because they have said it should have been totaled. Tell them to send over the check so you can buy a replacement car 1 year newer. (Like they say in commercials)... Then when they get confused by you taking control, tell them it's you looking out for the customer and since no one there wanted to step up, you are giving them the guidance to do the right thing. Then call the local news station. They love consumer justice stuff. Good Luck!
 
As a person who works for an insurance company, I would suggest that you ignore everything in the post above this one. Sorry, BC, but that's not the way to handle this - and can result in denial of the claim.

News station would probably love it, though. That I can get behind. ;)
 
The shop finished my car two days ago. It cost $20,200 plus $2000 for my rental car. As soon as I left the shop, the low tire pressure light came on. Took it back, they filled the tires. I'm low on gas so I pull into a gas station, press the button to open the little fuel door.. It won't open. Took it back and they fixed it. It was a nice day, so I decided to open the sunroof.. But it won't open. So I've contacted LM cause I don't want them billing me separately for these issues.
I did take it to a dealer and got a trade in value on it just to see how much of a loss I'm going to be taking. They offered 20k, I paid 27,5 six months ago. Hopefully my witnesses will call back, but they were just contacted last week for an accident that happened on December 12th.
Just thinking that it'll be time and money to appeal this with LM and it might not work. My case would be based on the adjuster not being competent. That he should have known to check certain things when doing the estimate, and he didn't. Alternatively, LM is now suing the city, which opens up my ability to sue the city for loss of value, etc. If they determine he cop at fault, I'll certainly win that one.

So here's the deal. I got a few trade in values from dealers. went to one of the Honda dealers who worked on the airbags, told the sweetest salesperson ever that I wanted 23k for my car and a 2014 Accord EX-L V6 with navigation for 28,500 and it's a done deal. He made it happen, and I'm a happy girl. Plus, made a new friend :)

The city finally admitted guilt two weeks ago. I submitted the Carfax value I had gotten of 17k, so they paid me 6k for depreciation.
