So i noticed that if i push on the shifter without pulling the clutch lever the bike shifts into gear, but the kickstarter wont budge unless you pull the clutch lever. i just replaced the clutch springs thinking that might help but nope..

did you try it in nuetral i dont think the 360 has primary kick ?
and shifting gears has absolutely nothing to do with the clutch, zero, they are 2 completely seperate mechanisms

I've tried kicking in neutral and nothing. Ohhhhhhhh so it should just alway shift? (pardon my noobness I've never done anything like this)

nuetral kick with clutch engaged(lever not pulled in) and yes as long as the shafts are turning or the gears happen to be lined up when not turning it will shift just as easy as with the clutch
in fact quicker smoother shifts with LESS strain on the trans or engine can easily be achieved with practice CLUTCHLESS

It isn't a primary kick like dirtbike, kickstart engages through transmission gears so turns rear wheel not engine.
