Engine stuck when using kickstarter but not stuck in gear

This is a sign of a bad kickstarter gear right? I put it in first and I can spin the wheel which obviously cycles the motor. Kickstarter won't budge though. I'm going to rebuild my cb125 motor. This isn't a split the cases type of situation is it?
 
if it is the old 19070's cb100 based motor you must split the cases to service kicker drive gear etc
will it kick the motor over in neutral ?
if you are going to have the cylinder and head off anyway splitting the cases is not that much more work
on a positive note it is a nice small light motor to work on :)
