ignition switch always on

I've been fighting with a dead battery over the last couple of days and worked my way up to the ignition switch. For some reason I can start the bike even with it turned to off and the key out of the ignition. Every thing seems to work the exact same regardless of position and with or without the key in the bike. Any ideas? This is my first build/bike so i'm definitely lost on what to do.

is the key turned to off and it still runs?

Yeah turned to off and key out of the ignition and it still starts (same result with the key in the ignition and set to off)

The switch is bad. Replace it and go from there. OR, somewhere along the line, some wiring has been rubbed bare, is touching, and bypassing the switch.
