Since my helmet and helmet spikes are getting worn out, I thought it was time to replace them. While browsing eBay, guess what I found?

Check out this eBay link. That's my fucking helmet in the picture. That's my bike's seat. That's my chair. That's my house. HAHAHA!!!! I'm not pissed. It's just that I would have never expected this...

Nice. I've been ripped off a few times. The only time I do anything is when they live close enough for a visit. Otherwise you just end up with high blood pressure and the needless urge to pound back scotch.... mmmm... scotch....
 
But Dr, if you came across this pic, wouldn't you rip it off too? ;D How could they resist?
 
You can protect your pictures by watermarking them, u can do it using pretty simple stuff like iphoto on macs, it will just be a faint lettering wherever you place it and i think it digitally encodes it too, so basically its copyrighted or whatever and u can come after someone legally if they use your stuff. My girlfriend does photography and posts it on the net so she has to protect all her stuff :)
 
Actually this is a company that is making money off of you, they either need to pay you for usage of your picture or they need to take it down: period. Unless you really don't care, but it would be a principle thing with me. Let the lazy mofos get a helmet, put some spikes on it and take their own damn picture!

Holy fuck! I just went to the ebay link again and I see that they have sold 20 of them! USING MY PICTURE!!!! This is an outrage!

I want your guys help. If you were in this situation, what would you say? I haven't done anything yet...
 
Since they sold 20 of them using my picture, I should... Get compensated for each sale they have made.

Dude, I am not exactly sure how to approach it exactly... But it has to be done. I suppose, start off politely and tactfully... And then go from there, based on their response. LOL... You kind of need to decide what kind of compensation you will ask for(or demand). Money?, product? And if they agree to compensate you, you need to decide whether or not you will allow them to continue to use the image going forward. Also- I guess maybe you should be 'cc:'ing eBay on whatever correspondence you have with the seller. Particularly if they ignore your initial attempt to contact them.
 
I've had some dealing with copywrite in the deep dark past when I was in the music business.

Generally speaking, you can request the "perpetrator" cease using the image (cease and desist order, it used to be called). If they don't comply, then you have the right to persue the matter legally. But you ALWAYS had to request them to cease using the copywritten images first of all before you could take the matter further.

Don't know if you can go any further in this instance, but I personally wouldn't waste my time on it. If you are REALLY offended by the guy using your image, sure - ask him to stop.

But I doubt the guy's going to give you money or freebies, but hey, stranger things have happened.
 
You know... I really don't care if anyone uses my picture. I just happened to be shopping for helmet spikes and I saw my picture. It would be pretty awesome if I get a freebie instead of paying $20 ::) .

We'll see what happens.
