They stole my picture! LOL!!!

I think you should state exactly how you feel, maybe something like: "Hello, I happened to be shopping for helmet spikes and came across your listing. I was a bit surprised when I noticed your ad with a picture that I personally took of my personal helmet with helmet spikes that I installed. If you would like to continue using the picture to generate revenue I feel that I should be compensated: how about 2 sets of spikes for permission to use the pic for this listing? In the alternative please cease and desist usage of this image for any and all purposes and please compensate me for the usage thus far with one free set of spikes. Thank you for your time and immediate attention to this matter."
 
Be sure to send that other picture so they know you're not some jackass trying to get free shit. I do think they could send you some spikes, for not being original enough to take a picture of their own damn product.
 
Make sure to water mark it first so they can't use that agianst you and just try to say your ripping them off too. :)
 
i would have done it as a matter of principle... If i ever saw one of my photographs being used for someone elses profit WITHOUT my permission, I would pursue the matter as much as possible. Thats copyright infringement. Period.
 
Doesn't something have to be copyrighted, for it to be copyright infringement?


They might have taken it down or maybe even given you some free spikes, but I doubt you had any legal standing.
