california Registration fee waiver

Has anyone successfully been able to get their fees waived in california? California vehicle code states that if the buyer was not cognizant of non-paid status, then the fees may be waived. I went in to transfer my title today and there is $590 worth of fees on the bike that I was told has been non-op since 2007. I have email conversations in writing printed for proof that the seller stated this. Just curious if anyones ever tried this and what their outcome is.

I'll let you know if its successful tomorrow afternoon. I'm still fucking livid the guy lied to me. It had an 07 sticker, so I assumed thats when he non-op'd like he said he did.
 
The seller should have given you a non-op cert with the bike. I've never heard of fees being waived. Especially since Arnie bankrupted the state.
 
I meant to add. Last week I took my '64 Fairlane off non-op. The tags are out in March. The DMV charged me the full year amount but the tags still expire next March. Five months driving for a years fee.
 
Saying Arnie bankrupted California is a bit prejudicial, especially since he was able to accomplish almost none of his abridgement policies, not to mention economic policy, like the budget, is first and foremost a congressional issue. However Hoofhearted is right as far as I know, I do not know how one can get around paying those fees. My wife's uncle buys salvaged title cars for re-sale and hasn't figured out a way. It might be possible maybe if a bike was out of the system for long enough.
However the times are not with you, California has instituted a lot of fee increases and other non-tax revenue generators this year and many of them apply to vehicles.
 
Maybe it was a cheap shot. But he was the gov. so he gets the blame. The chance you take in politics. Anyway I never much liked him. Too confrontational and too Hollywood for my liking. I think a vehicle has to be 7 years out of the system before back fees vanish.
 
California state parks used to be $30 a night. Arnie doubled it to $60. El Mirage entry used to be free. Now its $15 a day or $75 for a six meet pass. The SCTA now has to pay for rangers to be present at our meets so an additional $15 is tacked on to the entry fee. Upon reflection maybe it wasn't a cheap shot.
 
UPDATE: Ended up getting ALL of the penalties waived, but not the registration fees. So I had to pay for the previous years registration, but NOT the penalties from seller not paying for them. Dropped it from $621 to $257 for title transfer and my current registration. I cited CVC 9562 and used a statement of facts (REG 256) discussing the whole outcome. I brought in an email conversation quoting the seller as telling me it was non-op'd in 07, as well as a printout of CVC 9562. CVC 9562 basically says if a buyer is not aware that there are fees and penalties on the registration, then it MAY be waived by the branch manager. They told me the fees would've been waived too had it had a 2011 sticker on it, but because the sticker was 2007, they couldn't do it. She didn't ask for the sticker, but I had written the number on my statement, like the CVC says to do. She asked me the year and I told her 2007. I'm not sure if it was a honesty quiz and she had looked the sticker up, or what.

I had to go to 2 different DMV offices. The first office, the branch manager was extremely unpleasant and rude. She just kept mouthing off "Buyer Beware" which she apparently thinks trumps the vehicle code. She was only willing to waive half of SOME of the penalties which dropped it to $530 which was not helpful at all. The second office was extremely pleasant and I was in and out in about 25 minutes. They were extremely helpful. Almost frighteningly so... for the DMV.

So minor victory against the man last night. Now that my bike budget isn't blown, I can get back to working on it!
 
manteca = not helpful, took forever with appointment, overly crowded
tracy = helpful, fast, no appointment, underutilized

i've heard the sonora one is really relaxed and good for bike related stuff. ever had any problems up there?
 
I haven't had any problems there yet, but I will see when I try to get my 400 titled. It's been out of the system, so I'll need to get it inspected. That's a way off from now. I have witnessed a little 'tude from the woman at window #1 towards people without appointments. ;D
 
I don't know how it would have worked in the above situation, but I'd suggest if one is a AAA member, try registering through the Auto Club office. They helped me tag an old MGB with a dubious registration a few years ago and I walked away happy and legal. The Auto Club works for you and is much more service oriented. Also, they often seem a lot more knowledgeable than the bureaucratic DMV.

I signed up for AAA just so I could register the bike without going to the DMV. The lady said uhhhh, $621. And told me I should contact the seller to get him to pay it and there was nothing she could do. So off I went, $74 poorer, and only 5miles of towing. haha. Then I started my trip to the DMV.
