Short story.... I'm renting a house. The house was foreclosed on and recently sold at auction back to the bank. The bank assigned a property manager to handle the property.
Yesterday I get a text from the former owner asking if he can get some of the stuff he left in the house when he comes to pick up this month's rent check. He thinks I don't know about the house being sold.
So, what would you do to him? I'm not looking for legal advice, but some funny ideas would be welcome.
I thought of leaving him an envelope filled with monopoly money. Or tell him I will meet him some where and not show up. And then just keep doing that until he gives up.
If I could do it fast enough, I would just have him served with a summons to small claims court when he showed up. He still has my deposit and a month of rent he was not entitled to. Prick.
Yes, I have already changed the locks and the garage door codes.
Yep. Or just be up front and honest with the dude. Tell him you know about the foreclosure and sale, and that anything left in the house by him is now technically property of the new owner.
Honestly I'd probably tell him a time and let him show up.
Then tell him that you know he's not the owner and that he's trying to screw you out of your money, tell him that you want your deposit back and the first months rent that he stole from you or you will break his legs, scratch that take him to court.
Call the police then. What he is doing is trying to steal money from you and the new owner. Not to mention Fraud by representing himself as still being the owner.

I am with Redbird on this the fraud part could be serious in court not that the attempt to steal from you is not serious! You know you would maybe feel sorry for the guy if he was just a guy that lost a piece of property. But he is being an asshole trying to steal from you and who knows might have more than one piece of property. He may be trying this to others also.
Give him the option to do the right thing. Contact him, let him know you know he's not the owner and that you'd like your deposit and last months rent back. If he doesn't become honest and let you in on the situation, go the legal route and let him know that is what you plan to do. People are usually more willing to do things if you are upfront and honest. Yes it would be hysterical to keep having the guy meet you at places, not show up, etc... but who knows why this guy is broke. He could be blowing it on strippers, he could have a kid with cancer.
Monopoly money thing is funny,(I'd love to see the look on his face) But I'd be to pissed to play games. Redbird got a good point, he is tring to steal money from you and calling the law would be best. Good luck man.
