Dude, if she was at fault, her insurance should cover 100% of your medical bills. Nothing should have to come out of your pocket. Get a lawyer, and get one quick.
 
Sorry to hear about your accident . Hope everything heals up quickly and do what Justin said and get a lawyer asap sounds like the bitch will be paying up
 
Having been in a high-speed "t-bone" accident where a dude pulled out in front of me (moving 60mph) I got much more cautious on the motorcycle.


Every intersection I pass through I have already analyzed my escape path if the intersection were block.


Be very thankful you have escaped your first accident without major injury. This will either make you a better rider or just make you quit completely.
 
Thats too bad man. Same kinda thing happened to me. I didnt ride for 9 years afterwards. It was a huge mistake not to jump back in the saddle. But I'm riding now. I hope you get better soon. Contact the police and get a fekking lawyer!
 
Similar thing happened to by brother-in-law, but in his case, he was already halfway through the intersection and a lady drove right into the side of the bike. He was only doing like 35mph, but she crushed his foot so that it was basically hanging on by a thread. They took muscle and skin from other parts of his body to repair it all, and he won't be able to move faster than a brisk walk for the rest of his life. Not only are you blessed to be alive, but if you are predicted to regain 100% mobility, that would make you doubly blessed. He was hit by a little old lady who could barely see over the wheel--perhaps she moved to Cali, haha.... ugh. Anyway, insurance companies exist for a reason. The lawyer should be taken care of as well--get one.
 
If it was her fault, her insurance company should pay for EVERYTHING! Doctors bills, hospital bills, replacement of your bike, transportation to/from hospital or doctors visits. If you could drive, you could get a rental car. Contact the police from the scene and see if you can get a copy of the report. It should have her insurance info on it. Better yet, get a lawyer and they will do it for you. As the others said, you shouldnt have to pay for anything from this. Oh yeah, are you missing work? You can get lost income as well. Her insurance will be paying, not her, so don't feel too bad.

P.S. CB360, eh? Fun bike, but kind of hard to imagine that "gunning it" would result in alarmingly extra-legal speeds. ;)

Her insurance might not cover much. In california (and I suppose everywhere but here in Canada) You can buy a minimum amount of liability insurance. something like $12,000. so her company might be only willing to puy up to that amount. My sister was killed in california in october in a car accident and that was all the other guys insurance was good for.
 
WOW, what happened to you is my worst nightmare every time I hit the street. I've been pulled out on many times and so far have been able to evade. Glad to hear you'll be OK. I know folks that didn't come out of similar situations as lucky. I'm assuming you had a helmet and at least some sort of gear to escape more serious injury. Good on you for that. Get well and run that bitch through a nasty legal battle. She needs to pay.

Yeah, I get you. But that does not mean they are not responsible for the rest. I don't believe there is a law anywhere that puts a dollar amount limit on what someone is liable for. If their insurance that they bought doesn't cover the full amount, and they are not willing to pay the rest themselves, that is when you have to sue them.

Yeah Im sure with enough legal fees you could wring a little more out if their insurance, or themselves. Hey maby you'll find yourself the proud new owner of a banged up car and someone house!
 
That is one main reason I don't ride anymore, people now a days are so distracted, always in a rush or on their cell phone or texting and driving. Something similiar happen around my house this past weekend, unfortunately the guy died. Hope you recooperate soon.
 
Sorry for your lass DB. My thoughts are certainly with his family.

This just goes to show though, even though the cars out there can be the downfall of us, we can be our own worst enemies as well.

One thing occurs to me this morning....what were you wearing on your feet during this ordeal? I'm took a little flight of my own 8-9 years ago and landed on my heals pretty hard(think flying barkolounger position), destroyed both my boots but I walked (hobbled) away with nothing more than bruising and a need for new boots.
